Terms and Conditions
1. All images, animations, Videos, fonts and other graphic content have all copyright licensing bought and paid in full by 3RD Design. Content provided by you the client must also have partial or exclusive licensing. It is not the responsibility of 3RD Design Studios to check images, animations, Videos, fonts and other graphic content.

2. Some Images sound, video and some graphics might be sourced from legal entities who sell to us professional footage or pictures that bring the standard of production for all our design to a very high level, whilst at the same time keeping the costs minimal.

3. Each project has a timeframe in which it needs to be completely developed in. Your project is scheduled to be developed in a timeframe specified in your invoice statement.

If the development of the project exceeds this timeframe, Your Company will be charged by the hour for additional hours invested into your logo design.

4. Ongoing updates to the project are not included with this proposal. Web design, graphic print design, stationary, or any other services that we provide here at 3RDDESIGN.COM studios as part of DHD Web and Graphic Design studios is not included in the cost of this web package.

5. All content for web development must be submitted before the commencement of the project. All content, including pictures and written text, must be provided, and it is understood that their authorization of use has been gained all authorization of use of content.

Relates to web hosting services only

6. All web packages that include online web hosting, which comes free for one year. After this, Your company will need to renew the next yearly hosting charges. This does not include your domain name hosting.

7. If you wish to suspend or cancel your web hosting for that year, you will lose online access to your website but you will have the ability to upload your website to a location of your choice.

8. When purchasing your website package, you will receive 100 MB of online space along with 20 email accounts that you can set up via the web hosters online portal. Please note that each email account is allocated 10 MB of space, which is included in the 100MB of your online web space. (1MB = 1024 KB). The maximum file sending capacity for emails is caped at 8MB.

9. Your online Bandwidth per month is around 20,000 KB (or) (2GB). This is the bandwidth space that allows people to download your website. If your website exceeds this amount, there will be an additional charge for extra bandwidth for every extra mega bite (MB) that is downloaded.

10. Your domain name will be an additional charge and will be completely owned by Your Company if you choose to purchase this through us. Please note that domain name has an additional charge that is not included in your initial invoice statement. Renewal of a .com domain name will be on yearly bases, unless specified or directed otherwise. Renewal of a .com.au domain name will be on yearly bases, unless specified or directed otherwise.

11. Your website is allowed one database on its hosting plan, which will be hosted on a LINUX server, using phpMySql software. Requirement of additional databases will have additional cost incurred to your existing renewable hosting plan.

12. Online manipulation of the database directly by Your company or its associates is not allowed unless requested.

13. In the case of emergency updates and maintenance of server, it is possible for your website to go offline for a maximum period of 3 hours. This is essential for the development and upkeep of channel traffic to your website.

14. 3RDDesign.com maintains the upkeep and integrity of its online service and reserves the right to change hosting platforms whenever upgrades are required.

15. All accounts under $1650 must be paid in full before the commencement of developing the project online.

16. All accounts over $2650 must have an initial deposit of 30% the total investment amount of the project paid in full before the commencement of developing the project online.

17. All proposal documentation must be signed by the owner or legal representative of your company in order to commence with a project.

18. During project development: A project or design or online application system can be approved via email from the appropriate contact and does not need an official signature of approval.

19. All Outstanding amounts owing on accounts must be paid within 24 days. If payments are not made within 24 days.

20. If your account has been terminated or suspended as a result of breaching our terms and conditions, non-payment, or a formal complaint is received, no refunds will be given.

21. 3RDDesign.com do not provide refunds for products or services that have been purchased already. In the event of outsourcing certain documents, images, graphics, videos or consultancy times, refund of resource allocation will not be possible. Outstanding balances that have not been allocated to additional resources for your project will be refunded in full.

22. Any proof of misleading and/or false information given to our Your company or its employees, or improper conduct towards our employees, including threatening, extortion, harassment, abuse, swearing or other unlawful activities will lead to automatic cancellation of your account without refund. This includes any communication via email, live chat, telephone, or other forms of communication in which staff may be threatened, abused or mistreated.

23. If projects have been commenced and the client is considered to be too demanding, increased the scope of the project to go well beyond the project deadline date, and Disrespectful in any way, 3rddesign.com reserve the right to discontinue the project without refund.
